So, most people think estate planning is just about having a will or a trust, and those matters are important, and they matter a lot. But in reality, what your heirs often struggle with most after you’re gone, it’s not legal documents, but it’s also finding and figuring out your assets and your debts. So, one of the most important gifts you can leave for your heirs is organization and clarity.
First, estate planning basics. At a minimum minimum, you need to have powers of attorney, a will, and for many people, a trust. You also want to have beneficiary designations updated on retirement accounts and life insurance. Those documents decide who gets what, but they don’t explain what exists or where it is. And that’s where a lot of real work comes in for your heirs.
Your heirs need a clear list of assets. Bank and investment accounts, retirement plans, life insurance, real estate, business interest, valuable personal property, and just as important is a list of debts and obligations if they have them. Mortgages, credit cards, personal loans, taxes, ongoing bills. If you don’t write those down, your heirs are going to be left guessing, and that’s going to cost them time, money, and stress.
Your ears also need access. Where are these important documents? We’re talking about their will, their trust, their powers of attorney, their deeds and titles, insurance policies, passwords or password manager access, digital accounts nowadays like crypto and online accounts, or stored photos. This information needs to be secure but not hidden so no one can find it. A safe, a locked file, a digital vault. And you need to have someone you trust to know how to find that information.
And finally, also helpful, include instructions and context. Who’s your lawyer if you have one? Who’s your accountant? Who’s your financial advisor? Your insurance company? Are there items with sentimental value that you want handled a certain way? In short, your heirs are not just inheriting your assets. They also inherit either the mess or the plan that you’ve left behind. So, a simple, organized road map is one of the most thoughtful things you can ever give them.
